TERMS & CONDITIONS

These Terms & Conditions govern your use of the FPRMembers website and platform operated by Family Protection and Recreation LLC (“FPRMembers,” “we,” “us,” or “our”).
By accessing our website, creating an account, or making purchases, you acknowledge that you have read, understood, and agree to be bound by these Terms & Conditions, as well as our Membership Agreement, Privacy Policy, Return Policy, and Shipping Policy, all of which are incorporated by reference.
ELECTRONIC ACCEPTANCE
By clicking “I Agree,” creating an account, or making a purchase, you are electronically signing this Agreement and consent to be bound by electronic signatures under the E-SIGN Act and state Uniform Electronic Transactions Acts.
1. ACCOUNT & ELIGIBILITY
You must:
Be at least 18 years old to create an account
Be at least 18 to purchase long guns where permitted by law; 21 to purchase handguns and certain regulated items, subject to federal, state, and local law
Be legally allowed to possess firearms and ammunition
FPRMembers reserves the right to deny or terminate accounts for fraud, legal risk, abusive behavior, excessive returns, or chargeback abuse.
2. FIREARM PURCHASES & COMPLIANCE
2.1 FFL Transfer Requirement
All firearms MUST be shipped to and transferred through a valid Federal Firearms Licensee (FFL). No exceptions.
2.2 FFL Dealer Relationship
FFL dealers are independent contractors and are not agents, employees, or representatives of FPRMembers. We are not responsible for FFL dealer fees, hours, transfer procedures, additional state/local requirements, or customer service provided by FFL dealers.
2.3 Your Responsibility
You are responsible for selecting an FFL, confirming fees and hours, and picking up your firearm within 14 days of arrival at the FFL dealer and reviewing transfer fees with your chosen FFL before placing an order.
2.4 CRITICAL Inspection Requirement
You MUST inspect the firearm at the FFL BEFORE completing ATF Form 4473. Once the transfer is accepted, ALL SALES ARE FINAL.
2.5 Background Check Required
A successful FBI NICS background check is required before a firearm can be transferred to you.
2.6 NICS Denial — Store Credit Only
In the event of a NICS background check denial, the original order will be converted to store credit in the full amount paid (excluding FFL transfer fees and shipping costs). Store credit does not expire and may be applied toward any non-firearm product available on FPRMembers.com. No cash refunds will be issued for denied NICS background checks, except where required by law. Processing, distributor handling, and shipping costs are incurred at the time of order and are non-refundable. Membership fees are non-refundable once activated, except where required by law or in the event of a billing error.
2.7 NICS Delay — FFL Discretion
If the FBI NICS delay expires without an approval or denial (“default proceed” situation under 27 CFR § 478.102), the receiving FFL retains sole discretion to determine whether the transfer may legally proceed.
FPRMembers is not responsible for FFL decisions regarding delayed NICS responses. If you choose not to wait for explicit NICS approval and the FFL declines to transfer, standard return fees apply per our Return Policy.
2.8 Unclaimed Firearms
If you fail to pick up the firearm within 14 days of arrival at the FFL for any reason:
Refund = Purchase price MINUS:
$30 return shipping fee
Original outbound shipping costs
15% restocking fee
Total customer fees will not exceed 20% of the purchase price.
Membership fees are non-refundable once activated, except where required by law or in the event of a billing error.
2.9 Compliance with Federal & State Laws
You are solely responsible for knowing and complying with all federal, state, and local laws that apply to you.
2.10 No Straw Purchases — Federal Crime
Purchasing a firearm for someone who is not legally eligible is a federal crime and results in:
Permanent account termination (no refund)
All applicable refunds denied
Reporting to law enforcement
3. Minimum Advertised Pricing (MAP) Policy
Family Protection and Recreation LLC (“FPR”) is committed to maintaining the integrity of the brands we sell. We voluntarily adhere to Unilateral Minimum Advertised Pricing (MAP) policies established by firearm, ammunition, optics, and accessory manufacturers.
3.1 Public Pricing (Non-Members)
All prices visible on public pages follow the manufacturer’s MAP standards.
We do not advertise prices below MAP on any public-facing page.
3.2 Member Pricing (Authenticated Access)
FPR operates a dual-pricing model:
Public visitors see MAP-compliant pricing.
Authenticated members may receive different pricing as part of their member benefits, when allowed by manufacturer policy.
Member pricing is only visible after secure authentication and is not publicly advertised. This pricing is still operated in full compliance with manufacturer policies and is never accessible to non-members.
3.3 In-Cart Pricing
For certain brands, manufacturers allow lower pricing to be shown only in the shopping cart. In those cases:
Public pages will show MAP-compliant pricing.
Actual purchase pricing may be shown only after the product is added to the cart.
You may remove the item from your cart at any time.
If a manufacturer prohibits any below-MAP display, the page will show: “MAP-restricted — No member pricing available for this item.”
3.4 No Circumvention of MAP Rules
FPR does not modify, alter, bypass, or circumvent MAP pricing requirements in any form. We do not use promotional codes, member discounts, or any mechanism to publicly advertise prices below manufacturer-mandated MAP thresholds.
3.5 Price Accuracy & FTC Compliance
While we strive to display accurate pricing at all times, errors may occur. We reserve the right to correct pricing errors and will notify affected customers when necessary. Once a price is revealed in the cart, we do not add surprise “junk fees.” Only shipping, applicable taxes, and any mandatory state or local fees (such as required background check fees) may be added at checkout.
3.6 MAP Monitoring & Enforcement
FPR maintains internal monitoring to help ensure ongoing MAP compliance. We review product listings regularly, audit distributor feeds, and promptly correct any MAP-related issues that may arise. Any suspected MAP concerns can be reported to us so they can be reviewed and addressed.
3.7 FTC Testimonial Compliance
All testimonials must be genuine member experiences.
Savings amounts over typical results require a “results may vary” note.
Paid testimonials must be clearly disclosed.
4. ORDERING & PURCHASING
4.1 Pricing & Availability
Prices and stock availability may change without notice. We do not guarantee product availability or distributor inventory accuracy.
4.2 Order Cancellation
We may cancel any order at our discretion for any reason (membership remains non-refundable once activated, except where required by law or in the event of a billing error).
4.3 Governing Policies
All product transactions are governed by our Return Policy and Shipping Policy. Purchases may require adult signature or government ID verification.
5. PROHIBITED USES
You may NOT use the FPRMembers website or platform to:
Violate any firearms law or attempt illegal transfers
Purchase products for prohibited persons
Engage in straw purchases
Conduct unauthorized reselling or commercial operations
Abuse discount access for resale profit
Create fraudulent accounts or initiate chargebacks
Abuse return policies
Attempt to scrape pricing or data from the platform
5.1 Export Restrictions & ITAR Compliance
Firearms, ammunition, and related technical data are subject to U.S. export controls under the International Traffic in Arms Regulations (ITAR) and Export Administration Regulations (EAR). You may not export, re-export, or transfer any products or technical data without proper authorization. Violation is a federal crime.
Violation of prohibited uses may result in:
Immediate account termination (without refund)
Permanent ban from the platform
Legal action and law enforcement notification
6. INTELLECTUAL PROPERTY
All content, trademarks, logos, and materials on the FPRMembers website are owned by FPRMembers and may not be copied, reproduced, or used without written permission.
7. DISCLAIMER OF WARRANTIES
All products are sold as provided by the manufacturer or distributor. FPRMembers does not manufacture firearms, ammunition, optics, or accessories. Defects are covered exclusively by manufacturer warranty unless otherwise stated.
7.1 UCC Disclaimer
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ALL PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT. SOME STATES DO NOT ALLOW EXCLUSION OF IMPLIED WARRANTIES, SO THE ABOVE MAY NOT FULLY APPLY TO YOU.
Warranty claims must be filed directly with the manufacturer.
8. LIMITATION OF LIABILITY
To the fullest extent permitted by law:
FPRMembers is not liable for indirect, incidental, consequential, punitive, or exemplary damages
Maximum total liability shall not exceed the total amount you paid in the 12 months preceding the claim
Firearms, ammunition, and accessories must be handled safely. You are fully responsible for your personal safety, compliance with all applicable laws, and proper use of all products.
9. BINDING ARBITRATION & DISPUTE RESOLUTION
All disputes arising from or relating to your use of FPRMembers, purchases, or membership shall be resolved exclusively through binding arbitration administered by the American Arbitration Association (AAA) under AAA Consumer Arbitration Rules.
9.1 Arbitration Terms
Arbitration Location: Pinal County, Arizona
Governing Law: State of Arizona
No Class Actions: Disputes must be brought individually. You waive all rights to class actions and class arbitration.
No Jury Trials: You waive your right to a jury trial.
The arbitrator’s decision is final and enforceable in court.
If required by applicable consumer protection law, the arbitration venue may be adjusted to the consumer’s county of residence.
9.2 Costs & Attorney Fees
Each party bears their own attorney fees unless the arbitrator awards fees to the prevailing party.
9.3 Small Claims Exception
Either party may bring claims in small claims court if the claim qualifies for that jurisdiction.
9.4 30-Day Negotiation Requirement
Parties must attempt good-faith resolution for 30 days before filing arbitration by contacting info@FPRMembers.com.
9.5 Opt-Out Right
You may opt out of arbitration within 30 days of first accepting these Terms by written notice to info@FPRMembers.com with subject line “Arbitration Opt-Out.”
9.6 Temporary Injunctive Relief
Either party may seek temporary injunctive relief in Pinal County, Arizona to preserve the status quo while arbitration is pending.
10. TERMINATION
FPRMembers may terminate accounts for:
Violation of these Terms
Return fraud or chargeback abuse
Illegal activity or compliance risk
No refunds are given for terminated accounts.
11. AMENDMENTS
FPRMembers may update these Terms at any time. The most current version will be posted on www.FPRMembers.com with an updated “Last Updated” date. Continued use of the website or platform after changes constitutes acceptance of revised Terms.
12. SEVERABILITY
If any provision of this Agreement is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining provisions remain in full force and effect.
13. FORCE MAJEURE
FPRMembers shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to: acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, strikes, fuel crises, or supplier/distributor failures. During such events, obligations are suspended, and time for performance is extended by the period of delay.
14. RELATIONSHIP OF DOCUMENTS
These Terms & Conditions work in conjunction with our Membership Agreement, Privacy Policy, Return Policy, and Shipping Policy. All policies are incorporated by reference. In the event of conflict between documents, the most restrictive provision applies to protect both FPRMembers and our users.
15. Price Data Security
All member pricing is rendered server-side. Price scraping attempts, excessive page requests, or unauthorized access attempts may result in rate limiting or IP blocking.

17. Referral Program Terms
Referral rewards are subject to verification and approval by FPRMembers.
FPRMembers reserves the right to modify, suspend, or terminate the referral program at any time without prior notice.
Referral rewards have no cash value and are limited to the specific membership benefits described in the Referral Program.
Any abuse, self-referrals, or fraudulent activity may result in disqualification from the referral program and account suspension.

By using the FPRMembers website and platform, you confirm that:
You have read and agree to these Terms & Conditions
You understand firearms must ship to a valid FFL and transfers are final after inspection
You understand NICS denials result in store credit only (non-firearm products), except where required by law
You agree to arbitration in Pinal County, Arizona, subject to applicable consumer protection law
